  1. Acceptance of Terms

    By accessing or using any MSM Fundraising, LLC website or service, you agree to be bound by these Terms of Use. If you do not agree, you should not use our services.

  2. Description of Services

    MSM Fundraising, LLC provides a web-based platform that allows fundraising organizations, schools, and teams (“Clients”) to manage fundraising campaigns, accept orders, and communicate with participants and supporters.

    MSM Fundraising, LLC is a software provider and is not the seller of products offered in fundraising campaigns.

  3. Role of MSM Fundraising, LLC

    MSM Fundraising, LLC acts solely as a service provider to Clients. The Client is responsible for:

    • All fundraising campaigns and content
    • Products offered for sale
    • Order fulfillment and delivery
    • Customer service and dispute resolution

    MSM Fundraising, LLC does not guarantee the quality, safety, legality, or delivery of any products sold through its platform.

  4. User Accounts

    Users may be required to create an account to participate in a fundraiser.

    • You agree to provide accurate information
    • You are responsible for maintaining the confidentiality of your account
    • You are responsible for all activity under your account

  5. Children’s Use

    The platform may be used by students under the supervision of schools or parents/guardians.

    • Parents or schools are responsible for managing accounts for children under 13
    • Users represent that they have appropriate permission to create accounts for minors

  6. Orders and Payments

    All purchases made through the platform are transactions between the buyer and the fundraising organization. MSM Fundraising, LLC is not a party to any transaction between buyers and fundraising organizations.

    • Payments are processed through third-party payment processors
    • MSM Fundraising, LLC does not store credit card information
    • All pricing, products, and fulfillment are controlled by the Client

  7. Refunds and Disputes

    All refund requests, product issues, and disputes must be directed to the fundraising organization running the campaign.

    MSM Fundraising, LLC is not responsible for resolving disputes between buyers and Clients.

  8. Acceptable Use

    You agree not to use the platform to:

    • Violate any laws or regulations
    • Submit false or misleading information
    • Interfere with system operations or security
    • Attempt unauthorized access to any part of the system

  9. Service Availability

    We strive to keep our services available at all times but do not guarantee uninterrupted or error-free operation.

    We may suspend or modify services at any time without notice.

  10. Limitation of Liability

    To the fullest extent permitted by law, MSM Fundraising, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Further, in no event shall MSM Fundraising, LLC’s total liability exceed the amount paid to us, if any, for the use of the services excluding any commissions we collect.

    MSM Fundraising, LLC is not responsible for:

    • Products sold by Clients
    • Order fulfillment or delivery issues
    • Loss of profits or fundraising results
    • Unauthorized access to user accounts

  11. Disclaimer of Warranties

    The platform is provided “as is” and “as available” without warranties of any kind, express or implied.

  12. Indemnification

    You agree to indemnify and hold harmless MSM Fundraising, LLC from any claims, damages, or expenses arising from:

    • Your use of the platform
    • Your violation of these Terms
    • Any fundraising activity or content you manage (for Clients)

  13. Termination

    We reserve the right to suspend or terminate access to our services at our discretion, including for violations of these Terms.

  14. Changes to Terms

    We may update these Terms of Use from time to time. Continued use of the platform constitutes acceptance of any changes.

  15. Governing Law

    These Terms shall be governed by and interpreted under the laws of the United States and the State of Ohio in which MSM Fundraising, LLC operates.
